Terms of Service

Emergency limitation. AcuteAlert is not a substitute for professional medical advice, diagnosis or treatment. If you believe you are experiencing a medical emergency, call your local emergency number.

1. The service

AcuteAlert is a consumer health-information, personal safety, trusted-contact and escalation coordination platform. It evaluates health signals you authorize against rules you configure, notifies you and the people you designate, and presents emergency information you enter. AcuteAlert is not a physician, a medical diagnosis system, an emergency dispatch service, a guaranteed continuous monitor, or a medical device.

2. Eligibility and accounts

You must be at least 18 years old, or the age of majority where you live, to create an account. You are responsible for keeping your credentials secure and for activity under your account.

3. Your information

You are responsible for the accuracy of health information, Acute Card details and alert rules you enter. AcuteAlert never infers missing medical information. You must have the right to add the people you invite to your Circle.

4. Alerts and limitations

  • Alert timing depends on your devices, operating system delivery, network connectivity and notification settings that we do not control.
  • Alerts may be delayed, missed or incorrectly triggered. Do not rely on AcuteAlert as your only safeguard.
  • Circle members may or may not respond. AcuteAlert does not guarantee any response.
  • Call 911 opens your dialer; AcuteAlert does not place calls or dispatch emergency services.

5. Circle members

By joining a Circle you agree to receive notifications from that Circle owner. You may leave at any time. Owners control member permissions and may remove members at any time.

6. Subscriptions and payment

Paid plans renew monthly until cancelled. Free trials convert to paid unless cancelled before the trial ends. App purchases are billed and refunded by Apple or Google under their terms; web purchases are billed by Stripe and can be cancelled from Billing. Prices may change with notice. The Free plan remains functional.

7. Acceptable use

Do not misuse the service: no harassment via invitations or alerts, no attempts to access other users' data, no reverse engineering, no automated abuse. We may rate-limit or suspend accounts that violate these terms.

8. Intellectual property

AcuteAlert, its logo and software are our property. You retain rights to the content you enter and grant us a license to process it to provide the service.

9. Disclaimers

THE SERVICE IS PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND, INCLUDING FITNESS FOR A PARTICULAR PURPOSE. WE DO NOT WARRANT THAT ALERTS WILL BE TIMELY, ACCURATE OR UNINTERRUPTED.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ACUTEALERT WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR PERSONAL INJURY ARISING FROM RELIANCE ON THE SERVICE, AND OUR TOTAL LIABILITY WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM.

11. Termination

You may delete your account at any time. We may suspend or terminate accounts for violations of these terms or legal requirements.

12. Governing law

These terms are governed by the laws of the State of Texas, United States, without regard to conflict-of-law rules, and disputes will be resolved in the courts located in Travis County, Texas. [Placeholder pending confirmation by the account owner and counsel.]
